The petitioner, already in custody, seeks bail in connection with Begusarai Town P.S. Case No. 112 of 2015 registered under sections 302, 120(B)/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation in brief is that the F.I.R. has been lodged against unknown persons and the name of accused persons transpired on the basis of the confessional statement of the petitioner.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and except the confessional statement of the petitioner, there is no other material against him.

Patna High Court Cr.Misc. No.52858 of 2016 (4) dt.15-03-2017 Now the charge sheet has been submitted and two other coaccused persons were granted anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 4331 of 2016 and the petitioner has been in custody in this case since 16.12.2015. Having considered the aforesaid facts and circumstances, the petitioner, namely, Abhishek Kumar @ Suman @ Sumant @ Sumanta, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 112 of 2015.
