2. The petitioner apprehends his arrest in a case registered for the offence under Sections 191(2), 191(3), 190, 103 of the Bhartiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.
3. As per the prosecution case, on 22.07.2024 at around 11.30 O'clock, while the husband of informant was on way to Dalsingsarai Court, all the F.I.R. named accused persons surrounded him and thereafter, took out pistol from their waist and started firing on him, as a result of which, informant's husband sustained gun-shot injuries and died. The informant suspected that F.I.R. named accused persons, due to previous dispute, killed her husband.

Learned counsel for the petitioner submits that as per F.I.R., it is specific case of informant that due to previous dispute, all the F.I.R. named accused persons have committed murder of her husband. Petitioner is not named in the F.I.R. There is no whisper or suspicion against this petitioner in F.I.R. Name of the petitioner surfaced during course of investigation in the confessional statement of co-accused Prince Kumar. Petitioner claims clean antecedent.
5. Learned A.P.P. opposes the prayer for bail.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, Dalsingsarai, District - Samastipur in connection with Dalsingsarai P.S. Case No. 235 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
