2. Learned counsel for the petitioner is permitted to make the necessary correction in para no. 16 of this bail petition.

3. The Petitioner is apprehending his arrest in connection with Ahiyapur P.S. Case No. 719 of 2020 registered for the offences punishable under Sections 414, 356, 379, 34 of the Indian Penal Code and 25(1-b)a, 26, 35 of the Arms Act.

4. As per the prosecution case, on 03.09.2020 at around 3:40 P.M., the informant along with other apprehended two individuals. These individuals were being chased by members of the public who were shouting "Chor-Chor". Upon

Patna High Court CR. MISC. No.51967 of 2026(2) dt.29-07-2026 2/3 apprehension, the police recovered two pistols, a smart card, motorcycles, a number of SIM cards, and ATM card, and smartphones. The apprehended persons disclosed their names as Karan Kumar Pandey and Md. Asique.

5. Learned counsel for the petitioner further submits that the petitioner has nothing to do with the present case and that his name has been added merely on suspicion. Learned counsel for the petitioner further submits that, although it is true that one of the apprehended persons happens to be the brother of the petitioner, the petitioner's name has been subsequently added only on that basis. Learned counsel for the petitioner has also submits that the petitioner has one criminal antecedent.

6. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.

7. Having heard the parties and taking into account the fact that prima facie the name of the petitioner has been added in this case merely on suspicion, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, in connection with Ahiyapur P.S. Case
