Petitioner is apprehending his arrest in connection with Madanpur P.S. Case No.73 of 2023, registered for the offence punishable u/s 379, 411, 429, 272, 34 of the IPC and sections 7/15 of the Environment Act & Section 11(a)(d) of the Prevention of Cruelty to Animal Act, 1960 and section 4 of the Bihar Prevention and Improvement of Animals Act, 1955. 3.

Allegation against the petitioner is that he is running slaughter home in connivance with the other accused persons and exporting the beef to Bengal. From a truck, beef was recovered by the police.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence.

Patna High Court CR. MISC. No.56036 of 2024(2) dt.21-08-2024 2/2 He has been falsely implicated in this case due to ulterior motive. No such occurrence in the manner as alleged has ever taken place. No incriminating article has been recovered from the conscious physical possession of the petitioner and he has no concern with the alleged recovery of beef from the truck. Petitioner has no criminal antecedent and the driver and the khalasi of the truck have been granted bail by the Court below itself.

Learned APP for the State opposed the prayer for bail by submitting that there is specific allegation against the petitioner of exporting beef and running slaughter house. 6.

Considering the aforesaid facts and circumstances and the nature of allegation, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.

This application is accordingly dismissed.
