The petitioner has filed the instant application for grant of regular bail in a case registered under sections 8, 20, 22, 23 and 29 of the N.D.P.S. Act.
As per allegation in the F.I.R., it is stated that 9 kgs of ganja was recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in this case. He is in custody since 14.10.2020 and has no criminal antecedent. Heard learned A.P.P. for the State.
As per the antecedent report received from the
Patna High Court CR. MISC. No.10145 of 2021(3) dt.02-08-2021 2/2 Superintendent of Police Kishanganj, the petitioner has no criminal antecedent.
Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for over 9 months, the Court directs the petitioner to be enlarged on bail in connection with Kochadhaman P.S. Case No. 251 of 2020 (Special Case No. 13 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, N.D.P.S. Act, Kishanganj. (Partha Sarthy, J) Bibhash U T
