2. The petitioner is apprehending his arrest in connection with Complaint Case No. 1250 of 2023 for the offence under Sections 498A of the Indian Penal Code.

3. It is a case of matrimonial dispute between the parties. Petitioner is the husband of complainant. Allegation against the petitioner and his family members is of torturing, assaulting and ousting the complainant from her matrimonial house due to non-fulfillment of dowry demand.

4. Learned counsel for the petitioner submits the allegations leveled against the petitioner and his family member is absolutely false and fabricated. Petitioner has neither demanded any kind of dowry from the complainant nor

Patna High Court CR. MISC. No.55653 of 2024(4) dt.27-02-2025 2/2 committed cruelty to the complainant. He further submits that complainant left her matrimonial home prior to lodging of the complaint petition. Hence no case is made out under Section 498A of Indian Penal Code

5. Learned APP opposes the prayer of bail.

6. During course of argument learned counsel for the petitioner submits that petitioner is ready to keep his wife (complainant) with full honour and dignity. Contrary to this, the learned counsel appearing on behalf of the complainant submits that complainant does not wants to live with petitioner.

7. Keeping in view the above facts and considering the bona-fide conduct of the petitioner, let the petitioner be enlarged on anticipatory bail in the event of arrest or surrender within a period of four weeks from the receipt/production of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Banka in connection with Complaint Case No. 1250 of 2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (S. B. Pd. Singh, J) prabhakar/- U T
