Petitioners apprehend their arrest in connection with Dumaria P.S. Case No. 31 of 2015 registered for the offences punishable under Section 420, 467, 468, 120(B) of the Indian Penal Code.

Learned counsel for the petitioners submits that entire dispute arose on account of the fact that there was a dispute with regard to some piece of land and when the informant started making construction over the same, the petitioner resisted to it which resulted in some altercation between them. Patna High Court Cr.Misc. No.33192 of 2015 (2) dt.24-08-2015 2/2 submits that the dispute in question took place at a private piece of land and not at a public view nor there was any witness and hence, provision of Section-3(i)(x) of SC/ST (Prevention) of Atrocities Act is not attracted. Considering the aforementioned facts and circumstances and also the fact that petitioners have no criminal antecedent, let the petitioners, named above in the event of their arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned Sub Divisional Judicial Magistrate, Sherghati, Gaya in connection with Dumaria P.S. Case No. 31 of 2015 subject to conditions as laid down u/S 438(2) of the Cr. P.C. (Anjana Mishra, J) A.K.V./- U T
