This application for regular bail arises out of Sherghati P.S. Case No. 26 of 2021, disclosing offence punishable under Sections 341, 323 and 427 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner has submitted that the offences under the Indian Penal Code levelled in the FIR are bailable. There is allegation against the petitioner of having opened fire with a country-made pistol which, admittedly, did not hit the informant. The petitioner is in custody since 13.08.2021. The alleged fire-arm, said to have been used by the petitioner, has not been seized/ recovered.

Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned ACJM, Sherghati, Gaya, in Sherghati P.S. Case No. 26 of 2021. (Chakradhari Sharan Singh, J) Rajesh/- U T
