Petitioner seeks bail in connection with Shambhuganj P.S. Case No. 78 of 2016 registered under Sections- 341, 323, 307, 427, 504/34 of the Indian Penal Code to which section 302 IPC was added later on.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case at the instance of persons who are in inimical terms with the petitioner. In the scuffle both sides sustained injuries. Similarly situated coaccused persons have been granted bail by this Court vide orders dated 04.10.2016 and 09.02.2017 passed in Cr. Misc. No. 42139 of 2016 and 48580 of 2016 respectively.
Patna High Court Cr.Misc. No.1733 of 2017 (2) dt.28-02-2017 2/2 Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Shambhuganj P.S. Case No. 78 of 2016.
