This application for regular bail arises out of Nowkothi P.S. Case No. 56 of 2021, disclosing offence punishable under Sections 394, 395, 397, 412 of the Indian Penal Code.

Allegation in the F.I.R. is of snatching the informant's motorbike and a bag containing some cash and other documents. The petitioner is an accused in Hasanpur P.S. Case No. 93 of 2021 for the offence punishable under Sections 399, 402, 25(1b)a, 26, 35 of the Arms Act. Allegedly, during the course of investigation of said Hasanpur P.S. Case No. 93 of 2021, one Balram Jha, co-accused in that case, is said to have made confessional statement based on which the petitioner has been

Learned counsel for the petitioner has submitted that the petitioner has already been granted bail in the said Hasanpur P.S. Case No. 93 of 2021, and the petitioner's implication is mainly on the basis of confessional statement of the said Balram Jha. He further submits that there is no further material to justify the petitioner's implication in the present case. Considering the facts and circumstances as noted above, this application is allowed.

Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only), with two sureties of the like amount, each to the satisfaction of learned Judicial Magistrate 1st Class, Begusarai in Nowkothi P.S. Case No. 56 of 2021.

However, considering the fact that the petitioner has criminal antecedent, it is observed that if the petitioner is found indulging in commission of any cognizable offence in future, the prosecution shall be at liberty to apply for cancellation of bail granted to the petitioner by virtue of the present order.
