JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-11-2019 This application, for grant of anticipatory bail, arises out of Ekangarsarai P.S. Case No. 72 of 2019, disclosing offences under Sections 304(B)/34 of the Indian Penal Code. Petitioner happens to be mother in law, father in law and brother in law of the deceased and allegation against them is of causing death of the deceased for non fulfilment of demand of dowry.
Submission of learned counsel for the petitioners is that whole family members have been made accused in this case, however, no specific allegation has been attributed to the petitioners either of demand of dowry or of torturing the
Patna High Court CR. MISC. No.51988 of 2019(3) dt.04-11-2019 2/2 deceased prior to her death.
Learned counsel for the State opposed the prayer for anticipatory bail of the petitioners on the ground that the death is due to strangulation.
Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Hilsa, Nalanda, in connection with Ekangarsarai P.S. Case No. 72 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
