The petitioner no. 1 being the step brother of the husband of the victim and petitioner no. 2 being the wife of petitioner no. 1 are apprehending their arrest in a case registered for the offences punishable under Sections 149, 201, 302, 304B, 506 and 511/34 of the Indian Penal Code. The accusation is of killing the daughter of the informant after about seven years of marriage for nonfulfillment of the dowry demand. Though, earlier also an attempt was made to kill the victim in 2010.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.33899 of 2015 (2) dt.13-08-2015 2/2 petitioners that from the averments made in the complaint it appears that the death of the victim has still not been ascertained and the victim alleged to have disappeared on 04.03.2014 when the complaint was filed on 20.05.2014 which came to be registered as police case on 03.07.2014. The petitioners are step brother and sister-in-law (Bhabhi) of the husband of the victim and claimed to be separate from the husband of the victim from before.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Gaya in connection with Alipur P.S. Case No. 38 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
