Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.
The petitioner seeks regular bail in connection with Kuchaikot P.S. Case No. 340 of 2022 lodged under Section 30(a) of Bihar Prohibition and Excise Amendment Act, 2018. As per the prosecution case, the total recovery of 360 litres of country made foreign liquor has been made in this case. Learned counsel for the petitioner submits that he is a man of clean antecedent. He submits that the recovery of the said wine has been made in a Bolero vehicle. The allegation about the petitioner is that he was driving the vehicle but police has arrested him upon chase. Learned counsel for the petitioner
Patna High Court CR. MISC. No.53287 of 2022(2) dt.21-10-2022 2/2 further submits that he is in custody since 26.07.2022, charge sheet has already been filed in this case. He further submits that he was completely unaware about what is loaded in the vehicle. Learned counsel for the petitioner further submits that he is ready to fulfill all the conditions whatsoever shall be imposed upon him.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-IV cum special Excise Judge court No.2, Gopalganj in connection with Kuchaikot P.S. Case No. 340 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
