2. The petitioner seeks regular bail in connection with S.T. No. 328 of 2025 arising out of Pirpainti P.S. Case No. 549 of 2024 for the offence registered under Sections 103(1), 3 (5) of the B.N.S., 2023.
3. Allegation against the petitioner is that he along with other co-accused persons killed the brother of the informant by beating.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case on the basis of suspicion. No one has seen the occurrence of assault and the petitioner had surrendered himself before the Court. Except the confessional statement of the
Patna High Court CR. MISC. No.51291 of 2025(2) dt.11-08-2025 2/2 petitioner there is no material against the petitioner. Petitioner has one criminal antecedent of excise Act in which he is on bail. Charge-sheet has already been submitted. There is no chance of absconding of petitioner and tampering with the evidence. Petitioner is in custody since 17.12.2024 and he undertakes to cooperate in the trial.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.
6. Considering the submissions on behalf of the parties and the facts and circumstances of the case, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned concerned court below in S.T. No. 328 of 2025 arising out of Pirpainti P.S. Case No. 549 of 2024.
