1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.
2. The petitioner apprehends his arrest in connection with Arwal P.S. Case No. 180 of 2023 registered under Section 392 of the Indian Penal Code and later on, section 395 of the Indian Penal Code was added.
3. Learned counsel appearing on behalf of the petitioner submits that similarly situated co-accused Uttam Kumar has already been allowed bail by a Co-ordinate Bench of this Court vide order dated 23.08.2023 passed in Cr. Misc. No. 50411 of 2023.
4. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below
Patna High Court CR. MISC. No.53141 of 2023(2) dt.30-08-2023 2/2 within a period of four weeks from today, on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Jehanabad in connection with Arwal P.S. Case No. 180 of 2023, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
5. Any further condition that the court below shall verify the criminal antecedent of the petitioner and in case, at any stage, it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
