Petitioner apprehends arrest in a case registered for the offences punishable under Sections 379, 411 of Indian Penal Code and Section 56(2) of Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation and Storage) Rules, 2019.
It is alleged that this petitioner is involved in the business of illegal mining and transportation of sand. Coaccused who was apprehended on the spot has disclosed the name of the petitioner as owner of the tractor. Learned counsel appearing for the petitioner submits that the petitioner is innocent has been made accused in this case simply because petitioner is owner of the vehicle which is

It is further submitted that petitioner is a farmer and without his knowledge and consent his tractor was used by the driver for illegal transportation of sand. Petitioner has got clean antecedent.
Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Sadar, Motihari in Chakiya P. S. Case No. 99 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
