Petitioner apprehends arrest in a case registered for the offences punishable under Sections 272, 273 of Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per prosecution case, 10 litres country made liquor has been recovered from bush.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is submitted that alleged recovery has been made from open bush which is accessible to all. Nothing has been recovered from the conscious possession of the petitioner and he is in no way connected with the aforesaid recovery. Petitioner has got no criminal antecedent.

No.53504 of 2022(2) dt.18-11-2022 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge, Excise, Madhubani in Ladania P. S. Case No. 369 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
