JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,406 and 420 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. It is alleged that the contract for construction of school building was awarded to one Md. Imtiyaz. The informant being mason worked under Md. Imtiyaz but the payments were not made as per the rate fixed per sq.ft. for the construction when the informant demanded his share then he was abused by calling caste name.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.36458 of 2015 (2) dt.09-09-2015 2/2 that the petitioner was supervising the work at the instance of Md. Imtiyaz and basically the accusation arises out of contractual nature of dispute. It is further submitted that for the occurrence of 10.12.2012 to 9.12.2014 the FIR has been registered on 3.3.2015. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Samastipur in connection with Tajpur P.S. Case No.69 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
