2. The petitioner seeks bail in a case registered for the offence punishable under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act.
3. As per prosecution case, 351 litres illicit Nepali liquor was recovered from the seized vehicles.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. No incriminating article has been recovered from conscious possession of this petitioner and has been made an accused in this case merely on suspicion. Petitioner is neither owner nor driver of the seized vehicles. Charge-sheet has already been submitted and petitioner is in custody since 02.05.2025.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the facts and circumstances of the case, nature of accusation, fact that no incriminating article has been recovered from possession of this petitioner and period of custody, the prayer for grant of bail to the petitioner is allowed.
7. Accordingly, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge-cum-Exclusive Excise Court-2, Sitamarhi in connection with Sitamarhi Excise P.S. Case No. 232 of 2025.
