Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 395, 397 of the Indian Penal Code.
The informant being tractor driver was robbed and Rs. 20,000/- and mobile of the informant were taken away by the miscreants which led to the registration of the First Information Report against unknown. The name of the petitioner sprang up during investigation.
It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner and except confession of the co-accused there is nothing against the petitioner.
A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.34775 of 2015 (2) dt.17-08-2015 2/2 petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Jandaha P.S. Case No. 175 of 2014, pending in the Court of learned Chief Judicial Magistrate, Vaishali at Hajipur. Accordingly the application is disposed of.
