The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 376, 506, 328 of the Indian Penal Code.
The allegation against the petitioner is that after administering obnoxious substance to the informant, petitioner ravished her several times and made video. It is further alleged that petitioner threatened the informant of making the video film viral,

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. There is case and counter case between the parties. There is an inordinate delay of 17 days in lodging the F.I.R. Petitioner is in judicial custody since 29.06.2022.
Learned APP appearing on behalf of the State vehemently opposed the prayer of the petitioner and submitted that victim in her statement, recorded under Section 164 of Cr.P.C, has whispered about the complicity of petitioner in the alleged offence. She has stated that the petitioner has confined her in a room and after administering her obnoxious material, he committed rape several times and made video film. Having heard the learned counsel for the parties and considering the nature of allegation, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected.
