Mr. Nirbhay Kumar Singh, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-07-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State as well as the University.

The pay scale of the teachers in the University was revised in terms of the UGC package but the corresponding monetary benefit was not extended to the petitioner. The grievance of the petitioner in the present writ petition is non-payment of difference of salary for the period from April, 2001 to May, 2010 and from June, 2010 to February, 2013. There is no dispute about the grant of revised pay scale. The only issue is the allocation of fund by the State Government

Patna High Court CWJC No.15144 of 2019(2) dt.29-07-2019 2/2 for payment of difference of salary.

Considering the aforesaid, the writ petition is disposed of with a direction to the University to calculate the entitlement of the petitioner at the earliest preferably within a period of 30 days from the date of receipt/production of a copy of this order and thereafter to ensure payment to the petitioners within thirty days thereafter.

In the event the available fund is not adequate to meet the expenses, the University shall raise demand of allotment of additonal fund to the State Government and the State Government, after verification of such calculation release the fund so that the arrears is paid to the petitioner at the earliest. With the aforesaid, the writ petition stands disposed of.
