The petitioner is languishing in custody for the offences punishable under Sections 406, 420 of the I.P.C. The occurrence of abuse and assault took place due to non-performance of an agreement to sale between the parties. Submission is that similarly situated co-accused Raghvendra Prasad has already been allowed bail by this court. Learned counsel for the informant opposed the prayer for bail.

Considering the fact that there is no evidence of payment of rupees more than fourteen lacs in cash, let the

No.12748 of 2021(2) dt.05-07-2021 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Jakkanpur P.S. Case No. 05 of 2020 corresponding to G.R. No. 328 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.
