The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 376 of the Indian Penal Code.
Allegation is of physical exploitation on the pretext of marriage.
Submission is that petitioner is already married with the informant.
If, the informant supports the factum of marriage with the petitioner before the court below, the court below shall accept the bail bond of the petitioner.
In the aforesaid circumstances, let the petitioner, above named, in the event of his arrest or surrender before the
Patna High Court Cr.Misc. No.12218 of 2017(7) dt.04-12-2018 2/2 court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Pranpur Police Station Case No.148 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
