The petitioner apprehends his arrest in connection with Bhojpur (Ara) Mahila P.S. Case no. 71 of 2019, registered under Sections 376 and 506 of the Indian Penal Code and Section 3 and 4 of the Dowry Prohibition Act. The accusation is that informant came in touch of petitioner in course of study in Gandhi Memorial Children School. On assurance of the petitioner to perform marriage with her, she developed physical relation with the petitioner and on, occasionally, in absence of parents of petitioner, she used to visit at his house. But, since last two months the parents of the petitioner used to demand a four wheeler and cash of Rs. Three lakhs in dowry to perform Nikah of informant with the

Patna High Court CR. MISC. No.50917 of 2019(2) dt.16-08-2019 2/2 petitioner. While parents of the informant made several requests to parents of the petitioner but they did not give any heed on it.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that the informant has stated her age 18 years in her written statement. The petitioner has falsely been implicated in this case only for giving pressure to settle her marriage with the petitioner as parents of petitioner are not ready to perform the marriage of petitioner with the informant. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Ara Bhojpur in connection with Bhojpur (Ara) Mahila P.S. Case No. 71 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
