2. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 325, 308, 504, 498A, 34 of the Indian Penal Code and Section 3⁄4 of the DP Act.

3. The allegation in the first information report is that of assault and torture inflicted upon the informant who is the wife of the petitioner for demand of motorcycle and money in the form of dowry.

4. Learned counsel for the petitioner submits that the present FIR has been filed after a delay of seven months from the recording of the fardbeyan which was done on 22.01.2022 whereas the formal FIR was lodged on 06.09.2022. The plea taken by the petitioner in the petition is also that he is also ready to keep the informant as his wife with due dignity and honour.

However, upon issuance of notice to the opposite party no. 2, he was granted the privilege of provisional bail on 29.08.2023 and thereafter by way of several orders of coordinate Benches of this Court the provisional bail was extended. The last extension was granted on 26.07.2024. Further, charge-sheet has already been submitted.

5. Learned APP for the State has opposed the application for bail.

Taking into consideration the facts and circumstances and also considering the fact that the present case is one under 498A and 308 of the IPC and despite issuance of notice, the informant has not cared to appear in the present proceedings and the petitioner after having remained in custody from 07.09.2022, he was granted provisional bail on 29.08.2023, let the provisional bail granted to the petitioner vide order dated 29.08.2023 in connection with S. Tr. No. 199 of 2023, arising out of Ara Mufassil P.S. Case No. 300 of 2022, be confirmed by the learned court concerned.
