====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-02-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioner seeks bail in Aurai P.S.Case No. 116 of 2021 registered for the offences punishable under Sections 147,148,149,341,323,447,448,307,504 and 302 of the Indian Penal Code.

As per prosecution case, petitioner along with other twenty four F.I.R named accused persons variously armed and assaulted the father and brother (Sanjeev Sahni) of the informant. As a result of which brother of informant (Sanjeev Sahni) died on the spot.

It is submitted that direct allegation of assault is against other co-accused persons so far as petitioner is

Considering the aforesaid facts and circumstances as well as period of detention of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Muzaffarpur in connection with Aurai P. S. Case No. 116 of 2021.
