JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Neither petitioner was caught on the spot nor anything was recovered from his conscious possession. The name of petitioner was disclosed by the driver of pick-up-van and he stated that owner of the pick-up-van is one Smt. Sharmila Jha and the husband of the aforesaid Smt. Sharmila Jha had directed the driver to deliver the seized liquor to Vikash Kumar @ Chotu (petitioner). However, it is also clear from perusal of the F.I.R. that two persons were riding on the motorcycle and on seeing the police party, they fled away, leaving behind the aforesaid motorcycle. The informant claims that a wallet was recovered near the

Patna High Court Cr.Misc. No.46499 of 2016 (3) dt.05-12-2016 2/2 aforesaid motorcycle and in the said wallet, the Aadhar-card of the petitioner was found. It appears that except the aforesaid material, there is nothing against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Rosera at Samastipur in connection with Rosera P.S.Case No. 205 of 2016.
