The petitioner seeks bail in Barbigha P.S. Case No. 629 of 2017, registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3838 litres of foreign liquor has been recovered from Khalihan of co-accused Uday Singh and this petitioner along with others are alleged to have unloading the same from the truck.

It is submitted that no recovery has been made from conscious possession of this petitioner. Recovery has been made from Khalihan of co-accused and petitioner has got no concern with the seized liquor. Petitioner is in custody since 03.09.2021.

Learned APP however vehemently opposed the prayer for bail and submitted that petitioner has got criminal antecedent and one case is pending against him.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II, Sheikhpura in connection with Barbigha P.S. Case No. 629 of 2017, once the charge is framed in the case.
