Petitioner is accused in connection with Uchaka Gaon P.S. Case No. 119 of 2016 registered under Sections 302/120B/34 of the I.P.C.

The allegation against the petitioner is of killing the brother of the informant.

Learned counsel appearing on behalf of the petitioner submits that petitioner has got no criminal antecedent and he has been made accused in this case mere on suspicion. Further submission is that similarly situated co-accused persons namely, Alok Yadav, Surendra Yadav and Ram Bachan Yadav have already been allowed anticipatory bail by a Bench of this Court

Patna High Court Cr.Misc. No.49361 of 2016 (3) dt.11-01-2017 2/2 vide Cr. Misc. No. 51147 of 2016 and petitioner is in custody since 14.07.2016.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-IX, Gopalganj in connection with Uchakagaon P.S. Case No. 119 of 2016.
