The petitioners apprehend their arrest in a case under Section 498A and other sections of the Indian Penal Code. The wife of Vikram Saraf disclosed that she was married with Vikram Saraf on 29.01.2015 and all the family members of her husband participated in the marriage. It is alleged that accused persons including the petitioners assaulted her due to non-fulfillment of demand of dowry.

The petitioners are maternal uncle, aunt and brother of the husband of the complainant and the complainant has not made any specific allegation against them. The petitioners have, in no manner, concerned with the family affairs of the complainant.

No.25494 of 2015 (2) dt.10-07-2015 2/2 The learned counsel for the complainant has vehemently opposed the prayer for anticipatory bail and submitted that petitioners are instrumental and at their instigation she was subjected to series of physical and mental torture. On perusal of the complaint petition, it appears that although the complainant has arrayed the petitioners along with other relations of her husband as accused in the case but she has not made any specific allegation against the petitioners.

Considering the facts aforesaid, the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in Lakhisarai P.S. Case No. 253 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
