JUSTICE ARVIND SRIVASTAVA ORAL ORDER 13-12-2016 Heard learned counsel for the petitioner as well as learned A.P.P for the State.

The petitioner seeks bail in connection with Bodh Gaya P.S. Case No. 361 of 2016 registered for the offences punishable under Section 47(a) of the Bihar Excise (Amendment) Act, 2016.

Prosecution case is that on secret information, the police party raided the house of the petitioner and recovered two litre illicit liquor.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner has falsely been implicated in the present case and she is languishing in custody since 16.09.2016.

On behalf of the State, it is submitted that the

Patna High Court Cr.Misc. No.49858 of 2016 (2) dt.13-12-2016 2/2 petitioner is named in the F.I.R.

In the facts and circumstances stated above, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S. Case No. 361 of 2016.
