The petitioner seeks bail in connection with Sessions Trial No.255 of 2016, arising out of Sikandra P.S. Case No.90 of 2016, registered under Sections 364/34 and, later on, added Sections 302/201 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, one Trilouki Kora was apprehended by the police and the mobile set of the deceased Dinesh Mahton was recovered from his possession. Thereafter, on the basis of confessional statement of Trilouki Kora, the dead body of the deceased Dinesh

Patna High Court Cr.Misc. No.131 of 2017 (3) dt.22-02-2017 2/2 Mahton and the weapon, used in committing the murder of the deceased Dinesh Mahton, were recovered. Trilouki Kora also disclosed the name of his five associates including the petitioner having their hands in committing the murder of the deceased Dinesh Mahton. The dead body of the deceased Dinesh Mahton was recovered by the police on 13.07.2016 and this petitioner was apprehended by the police on 16.07.2016. Except the confessional statement of apprehended co-accused Trilouki Kora, there is nothing to show the complicity of the petitioner in the commission of the alleged offence. The petitioner having no criminal antecedent is in custody since 16.07.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Jamui, in connection with Sessions Trial No.255 of 2016, arising out of Sikandra P.S. Case No.90 of 2016.
