The petitioners are apprehending their arrest in a case registered for the offences punishable under sections 147, 341, 323, 324, 307, 379, 427 of the Indian Penal Code. It is alleged that the informant made protest for cutting iron sheet of the house of the informant. The informant was assaulted with iron rod on his head when the wife of the informant came to rescue but she was also assaulted. It is submitted by the learned counsel for the petitioners that the injuries were found simple in nature. There is counter version of the occurrence also. It is also submitted that
Patna High Court Cr.Misc. No.33699 of 2015 (2) dt.13-08-2015 2/2 the petitioners have got no criminal antecedents and a statement to this effect has been made in paragraph No.3 of the petition. Moreover co-accused Anjani Paswan and Bhushan Paswan have been granted anticipatory bail vide Cri. Misc. No. 18250 of 2015. Considering the aforesaid facts, the above named petitioners in the event of their arrest or surrender before the court below within a period of 12 weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned C.J.M, Madhepura in Madhepura P.S. Case No. 41 of 2015, subject to the conditions laid down under section 438(2) Cr.P.C.
