The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code. The prosecution case is that petitioner no.1 pushed the informant on the ground thereafter petitioner no.2 assaulted with mungari on his back. It is further alleged that petitioner no.1 assaulted with the butt of the country made pistol on the head of the informant and with farsa to the brother of the informant. Petitioner no.3 assaulted the father of the informant with spade. It is submitted by learned counsel for the petitioners that

Patna High Court Cr.Misc. No.32835 of 2015 (2) dt.14-08-2015 2/2 all the injuries have been found to be simple superficial in nature and for the petty dispute, the accusation has been levelled. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

It is submitted by learned counsel for the informant that the injuries have been found on the vital part of the body which shows the intention of the accused persons.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Sitamarhi P.S. Case No. 387 of 2015 pending in the learned C.J.M., Sitamarhi. Accordingly, the application is disposed of.
