====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 27-11-2018 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Chautham P.S. Case No. 26 of 2018, instituted for the offence under Sections 147, 341, 342, 323, 307, 379, 504 and 506 of the Indian Penal Code. Subsequently, Section 302 Indian Penal Code was added. It is alleged that petitioner along with ten other accused persons assaulted son of the informant with Bamboo on his head causing injury to him. The son of the informant was brought to Sadar Hospital, Khagaria, from where he was referred to Alexia Hospital Begusarai, for better treatment, but he died in Hospital during course of treatment. Counsel for the petitioner submits that there is general and omnibus allegation against the petitioner in the
Patna High Court Cr.Misc. No.69461 of 2018(2) dt.27-11-2018 2/2 Fard-e-beyan. Counsel for the petitioner further submits that co-accused Umesh Paswan with similar allegation has already been granted bail by coordinate Bench of this Court vide order dated 30.8.2018 passed in Cr. Misc. 50549 of 2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Brajesh Kumar, learned Judicial Magistrate 1st Class, Khagaria, in connection with Chautham P.S. Case No. 26 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
