JUSTICE SANJAY PRIYA ORAL ORDER 28-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 323, 307, 302, 504, 506 and some other allied Sections of the of the Indian Penal Code and 27 of the Arms Act.
It is submitted on behalf of the petitioner that there is general and omnibus allegation against him. Another co-accused namely Navjit Singh @ Navaleem Singh @ Lavlin Singh having similar allegation has been granted bail by a co-ordinate Bench of this Court in Cr.Misc. No. 52031 of 2016 on 08.12.2016. From the written report it also appears that no allegation of specific overt act is attributed against the petitioner. The petitioner is said to be in custody since 23.10.2016.
Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.309 of 2017 (2) dt.28-01-2017 2/2 the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Saran at Chapra in connection with Garkha P.S.Case No. 269 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
