Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 2.11.2018 passed in Cr. Misc. No.58554 of 2018 and again he prayed for grant of bail but the same was permitted to be withdrawn vide order dated 7.2.2019 passed in Cr. Misc. No.6351 of 2019. Submission of the learned counsel for the petitioner is that earlier the liberty was given to the petitioner that if the trial is not concluded within nine months, he may move for grant of bail and the petitioner is in custody for about 15 months.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts

Patna High Court CR. MISC. No.49884 of 2019(2) dt.14-08-2019 2/2 and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, West Champaran at Bettiah in connection with Trial No.30 of 2018 arising out of Bettiah Town P.S.Case No.675 of 2017, with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled. With the aforesaid direction, this application is allowed.
