The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,385,427 and 504 of the IPC and Sections 3 and 4 of Explosive Substances Act.
The prosecution case, as per the written report of Bhojraj Singh submitted to the SHO, Banka, is to the effect that on 12.6.2018 at 12.30 P.M. all FIR named accused persons and 10-15 unknown persons including the petitioner came variously armed with explosives and started demanding extortion. They also damaged the generator set by putting sand in it. It is further alleged that the accused persons threatened to kill the informant and other employees by explosives and they also exploaded bombs in the river.
Patna High Court Cr.Misc. No.70132 of 2018(2) dt.06-12-2018 2/2 It is submitted by learned counsel for the petitioner that due to business rivalry, the accusation has been levelled. The accusation is not specific against the petitioner. No one received any injury. Moreover, coaccused Bal Kishor Singh, Sandip Singh and Ghanshyam Singh have been granted bail by a Bench of this Court vide order dated 30.11.2018 passed in Cr. Misc. No.56747 of 2018.
Considering the accusation being omnibus and general and the fact that injury was not caused to anyone, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Banka in connection with Banka P.S. Case No. 407 of 2018 subject to the conditions laid down in Section 438(2) of the Cr.P.C.
