2. The petitioner seeks bail in connection with Bagen Gola P.S. Case No. 25 of 2025 instituted for the offences under Sections 103(1), 238, 61(1), 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. The prosecution case, in brief, is that on 11.03.2025 evening, three named accused persons took the husband of the informant to their village, and the next morning his beheaded body was found in a field, allegedly murdered by the said persons along with others.
4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case.
Patna High Court CR. MISC. No.50764 of 2025(3) dt.14-10-2025 2/3 Petitioner is not named in the F.I.R. The name of the petitioner transpired in this case on the basis of suspicion. No specific overt act is alleged against the petitioner. Learned counsel further submitted that there is no eye-witness to the occurrence. Learned counsel further submitted that except the confessional statement, there is no material to show the involvement of the petitioner in the alleged offence. It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.04.2025 and has no criminal antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. He further submitted that as per material available in the case diary, coaccused Mahesh Yadav @ Ghamari has confessed his guilt and has also disclosed the involvement of the petitioner in the commission of murder of the deceased. Learned APP further submitted that the said co-accused has also disclosed that coaccused Arun Yadav along with other accused persons committed the murder of the deceased by giving kudaal blow upon the deceased, which aligns with the post-mortem report of the deceased.
6. Considering the aforesaid facts and circumstances of the case, there being no direct allegation against the petitioner
Patna High Court CR. MISC. No.50764 of 2025(3) dt.14-10-2025 3/3 as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- ( Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Bagen Gola P.S. Case No. 25 of 2025.
