2. The petitioner seeks bail in connection with Bahoranpur P.S. Case No. 65 of 2024 dated 11.09.2024 instituted for the offence punishable under Sections 80, 3(5) of Bhartiya Nyaya Sanhita, 2023.
3. The prosecution case, in short, is that the marriage of the informant' daughter was solemnized with the petitioner in the year 2021. Soon after the marriage, it is alleged that the victim was subjected to demand of dowry and on account of non-fulfillment of the same, she was tortured. On 05.09.2024, an information was given to the informant that his daughter has consumed poison and she was being taken to the hospital. On
Patna High Court CR. MISC. No.53093 of 2025(3) dt.15-11-2025 2/3 the information afore noted, the informant rushed to the hospital, he found that his daughter was on ventilator and later on, she died during treatment.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. Learned counsel for the petitioner submits that the petitioner is the husband of the deceased. The entire case revolves around the suspicion. It is submitted that the deceased herself consumed poison due to which she died during treatment at JDM Hospital, Patna. This fact has been corroborated by the independent witness whose statement was recorded by the police. It is submitted that after knowing the true facts, the informant has also filed a petition that no such occurrence took place. Due to some confusion, the present case has been lodged. Lastly, it has been submitted that the petitioner is in custody since 21.05.2025 having two criminal case against him. Chargesheet has been submitted in the case.
5. Learned A.P.P. for the State opposed the prayer for bail of the petitioner. Learned counsel for the informant submits that due to some confusion, the present case has been lodged against the petitioner and his family members. He does not wants to pursue the matter.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-7, Bhojpur, Ara in connection with Bahoranpur P.S.
