JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420,467,468 and 471 of the Indian Penal Code.

The accusation is that the petitioner and others executed lease deed in favour of accused persons with regard to the ancestral and purchased land of the informant. It is submitted by the learned counsel for the petitioner that petitioner is the agnate of the informant and is in possession of the land and is paying rent of the land in question. It is further submitted that the land possession certificate has been issued in favour of the petitioner and with the permission of the Circle

Patna High Court Cr.Misc. No.33566 of 2015 (2) dt.31-08-2015 2/2 Officer the pond is being dug on the land in question and with ulterior motive the accusation has been levelled. Considering the accusation arising out of civil nature of dispute between the parties, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Sadar, Motihari, in connection with Keseriya P.S. Case No.155 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
