The petitioner seeks bail in Falka P.S. Case No. 394 of 2018, registered under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

60 litres of country-made wine is alleged to have been recovered from the possession of the petitioner. It has been stated in the application, seeking bail that the petitioner has no criminal antecedent. He is in custody since 27.09.2018.

Learned counsel for the petitioner submits that if the petitioner is again implicated in similar type of offence, the Court may consider cancellation of his bail, if allowed in the present case.

Patna High Court Cr.Misc. No.70283 of 2018(2) dt.04-12-2018 2/2 Considering the nature of allegation and submission made on behalf of the petitioner, this application is allowed. Let the petitioner above-named be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge 2nd-cm-Special Judge, Katihar in Falka P.S. Case No. 394 of 2018.
