This case is yet another example of use of Munna Bhai in examination.
The petitioner is apprehending arrest in connection with Katihar Muffasil P.S. Case No.172 of 2018 for offences under Sections 420 of the Indian Penal Code and 3⁄4 of Bihar Conduct of Examination Act, 1981.
Allegation against the petitioner is that in the matric compartmental examination one Miraj was caught by the examination Superintendent who was sitting in the examination on behalf of the petitioner.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and his name surfaced
Patna High Court Cr.Misc. No.68198 of 2018(2) dt.14-12-2018 2/2 on the confessional statement of said Miraj who was appearing at the examination. Counsel submits that Miraj was never contacted by the petitioner to appear on behalf of the petitioner in the examination.
Considering the fact that the petitioner has no criminal antecedent and his tender age, let the petitioner, above named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Dharmendra Singh, J.M. 1st Class, Katihar in connection with Katihar Muffasil P.S. Case No.172 of 2018, subject to the conditions as laid down under Section 438(2) Cr. P. C.
