The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 504/34 of the Indian Penal Code and 3/4 of the Prevention of Witch Practices Act.
It is alleged that the petitioners and others assaulted the informant saying that the informant is a Witch, as a result son of one of co-accused died. It is submitted by the learned counsel for the petitioners that for the occurrence of 23.10.2014 the First Information Report was registered on 02.11.2014. For a petty dispute accusation has been levelled. Statement has been made in para-3 of the petition that petitioners have no criminal

Considering the nature of accusation, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sri R.K. Pandey, Judicial Magistrate, Ist Class, Gaya in connection with Neemchak Bathani P.S. Case No. 128 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
