The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 395/412 of the Indian Penal Code.
Learned counsel for the petitioner submits that the only allegation as made against the petitioner is that one of the accused person was taken into custody at the place of occurrence and has given the name of this petitioner as by-stander. Considering the nature of allegation made in the FIR as against this petitioner and save and except the statement made by the co-accused and that there has been no recovery from the petitioner, let the petitioner Binod Yadav, in the event of his arrest
Patna High Court Cr.Misc. No.32918 of 2015 (2) dt.19-08-2015 / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur P.S. Case No. 20 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. It is, however, made clear that one of the bailors of the present case shall be the brother or close relative of the petitioner so as to ensure the presence of the petitioner at the trial.
