This application is for grant of bail in connection with Phulparas P.S.Case No.188 of 2016 for the offence under Sections 376, 450 of the Indian Penal Code and 4/6 of POCSO Act. It is submitted on behalf of the petitioner that though there is allegation under Section 376 of the IPC against the petitioner, however, the informant has been examined in the court below and she has not identified the petitioner in the court below. Heard learned A.P.P. also.

Having heard both sides. In view of the aforesaid facts, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if not concluded, the petitioner

Patna High Court Cr.Misc. No.48246 of 2016 (3) dt.16-02-2017 2/2 is at liberty to renew his prayer before the court concerned itself and the learned court below will pass appropriate order without being prejudiced by the order of this Court.
