2. The petitioner seeks regular bail in connection with Rosera P.S. Case No. 611 of 2023, registered for the offence punishable under Sections 414, 34 of the Indian Penal Code and under sections 25(1-B)a, 26, 35 of the Arms Act.

3. As per prosecution case, one country made pistol and one live cartridge were recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submit that petitioner has falsely been implicated in this case. Petitioner has four criminal antecedents out of which in three cases he is on bail. Petitioner is in judicial custody since 10.12.2023

5. Learned APP has vehemently opposed the prayer for bail.

6. Considering the aforesaid fact and also period of custody, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1st, Rosera, Samastipur in connection with Rosera P.S. Case No. 611 of 2023, subject to the condition that:

(I) The petitioner will mark his attendance at Ujiyarpur Police Station on every Sunday of each month and further petitioner will mark his attendance in Rosera Police Station at every Wednesday of each month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner.
