2. The petitioner seeks bail in connection with Mahua P.S. Case No. 737 of 2020 registered for the offence punishable under Sections 30(a), 32(ii), 34(ii), 38(ii) and 41(i) of the Bihar Prohibition and Excise (Amendment) Act.

3. The recovery is of 3276.720 litres of illicit liquor. The petitioner is in jail since 11.06.2024. Other co-accused have been granted bail.

4. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

5. Considering the period of custody and the fact that other co-accused have been granted bail, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court-II-cum-Additional District and Sessions Judge, Hajipur, Vaishali in connection with Mahua P.S. Case No. 737 of 2020.

7. The petitioner will also mark attendance in Mahua Police Station, Vaishali on every Sunday of the month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.

8. In case, it is found that the petitioner is accused in any other new case in future, his bail bonds shall be cancelled by the concerned Court below.
