====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-09-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with NTPC P. S. Case No. 105/2023 in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. Informant suspects that co-accused Abhishek Pandey, his wife, namely, Madhu Pandey along with other 3-4 unknown persons killed his son due to money dispute.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. Name of petitioner transpired during investigation on the basis of confessional statement of co-accused Abhishek Pandey. Save and except
Patna High Court CR. MISC. No.52490 of 2025(2) dt.19-09-2025 2/2 confessional statement, no other material is available on record to show complicity of this petitioner in the alleged offence. Petitioner is in custody since 22.04.2025. Charge-sheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 1st, Barh, Patna in connection with NTPC P. S. Case No. 105/2023.
